Legislative Consent: Tobacco and Vapes Bill (2024 - 2025)
The Tobacco and Vapes Bill (the Bill) was introduced in the House of Commons on 5 November 2024.
The long title to the Bill notes that it is a Bill “to make provision about the supply of tobacco, vapes and other products, including provision prohibiting the sale of tobacco to people born on or after 1 January 2009 and provision about the licensing of retail sales and the registration of retailers; to enable product and information requirements to be imposed in connection with tobacco, vapes and other products; to control the advertising and promotion of tobacco, vapes and other products; and to make provision about smoke-free places, vape-free places and heated tobacco-free places.”
The Bill is subject to the legislative consent process under Standing Order 29. This is when the consent of the Welsh Parliament is sought by the UK Government to legislate on an issue which falls within the competence of the Senedd.
The Legislative Consent Motion for the Bill was agreed in Plenary on 9 December 2025.

On 31 October 2025 the Welsh Government laid a Supplementary Legislative Consent Memorandum (PDF 180KB).
The Business Committee referred the SLCM to the Health and Social Care Committee and the Legislation, Justice and Constitution Committee with a reporting deadline of 2 December 2025 (PDF 72KB).
On 21 November 2025 the Minister for Mental Health and Wellbeing wrote to the Legislation, Justice and Constitution Committee withdrawing Memorandum No. 3.

On 4 April 2025 the Welsh Government laid a Supplementary Legislative Consent Memorandum (PDF 101KB).
The Business Committee referred the SLCM to the Health and Social Care Committee and the Legislation, Justice and Constitution Committee with a reporting deadline of 6 June 2025 (PDF 38KB).
The Legislation, Justice and Constitution Committee laid its report (PDF 183KB) on 23 May 2025. The Welsh Government responded (PDF 41KB) to the report on 3 July 2025.
The Health and Social Care Committee laid its report (PDF 114KB) on 6 June 2025.
Legislative Consent Memorandum – November 2024
The Welsh Government laid a Legislative Consent Memorandum (PDF 351KB) on the Bill before the Senedd on 20 November 2024.
The Business Committee referred the LCM to the Health and Social Care Committee and the Legislation, Justice and Constitution Committee with a reporting deadline of 7 February 2025 (PDF 36KB).
On 3 December 2024, the Business Committee agreed (PDF 48.2KB) a new reporting deadline of 21 February 2025.
