Legislative Consent: The Cultural Objects (Protection from Seizure) Bill

The Cultural Objects (Protection from Seizure) Bill (the Bill) was introduced in the House of Commons on 16 June 2021.

 

The long title to the Bill notes that it is a Bill “to extend the protection from seizure or forfeiture given to cultural objects.”

 

The Bill is subject to the legislative consent process under Standing Order 29. This is when the consent of the Welsh Parliament is sought by the UK Government to legislate on an issue which falls  within the competence of the Senedd.

 

The Deputy Minister for Arts and Sport, and Chief Whip told the Legislation, Justice and Constitution Committee that amendments to the Bill tabled during the House of Commons Report Stage, and agreed by the House of Commons, removed provisions within the Bill which fell under the legislative competence of the Senedd. The Senedd did not therefore consider a legislative consent motion for the Bill.

 

Legislative Consent Memorandum – December 2021

The Welsh Government laid a Legislative Consent Memorandum (LCM) (PDF 75.6KB) on the Bill before the Senedd on 10 December 2021

 

The Business Committee referred the LCM to the Culture, Communication, Welsh Language, Sport and International Relations Committee, and the Legislation, Justice and Constitution Committee, with a reporting deadline of 10 March 2022 (PDF 38.2KB).

 

The Culture, Communications, Welsh Language, Sport, and International Relations Committee laid its report (PDF 129KB) on 3 March 2022.

 

The Legislation, Justice and Constitution Committee laid its report (PDF 147KB) on 3 March 2022. The Welsh Government responded to the report on 17 March 2022.
