Legislative Consent: Building Safety Bill

The Building Safety Bill (the Bill) was introduced in the House of Commons on 5 July 2021.

 

The long title to the Bill notes that it is a Bill “to make provision about the safety of people in or about buildings and the standard of buildings, to amend the Architects Act 1997, and to amend provision about complaints made to a housing ombudsman.”

 

The Bill is subject to the legislative consent process under Standing Order 29. This is when the consent of the Welsh Parliament is sought by the UK Government to legislate on an issue which falls  within the competence of the Senedd.

 

The Legislative Consent Motion for the Building Safety Bill was agreed in Plenary on 29 March 2022.

 

Supplementary Legislative Consent Memorandum (Memorandum No. 5) – March 2022

 

On 25 March 2022, the Welsh Government laid a Supplementary Legislative Consent Memorandum (PDF 91KB).

 

The Business Committee agreed (PDF 46KB) that the Supplementary Legislative Consent Memorandum on the Building Safety Bill (Memorandum No. 5) will be considered and reported on to the Senedd by the morning of 29 March 2022.

On 22 February 2022, the Welsh Government laid a Supplementary Legislative Consent Memorandum (PDF 87.6KB).

 

The Business Committee agreed (PDF 38.1KB) that the Supplementary Legislative Consent Memorandum on the Building Safety Bill (Memorandum No. 4) will be considered and reported on, to the Senedd, by 22 March 2022.


The Legislation, Justice and Constitution Committee laid its report (PDF 229KB) on Memorandum No. 3 and Memorandum No. 4 on 17 March 2022. The Welsh Government responded to the report on 24 March 2022

On 20 January 2022, the Welsh Government laid a Supplementary Legislative Consent Memorandum (PDF 156KB).

 

The Business Committee agreed (PDF 39.3KB) that the Supplementary Legislative Consent Memorandum on the Building Safety Bill (Memorandum No. 3) will be considered and reported on, to the Senedd, by 17 March 2022.

Supplementary Legislative Consent Memorandum (Memorandum No. 2) – September 2021

 

On 21 September 2021, the Welsh Government laid a Supplementary Legislative Consent Memorandum (PDF 88.7KB).

 

The Business Committee agreed (PDF 39.1KB) that the Supplementary Legislative Consent Memorandum on the Building Safety Bill (Memorandum No. 2) will be considered and reported on, to the Senedd, by 18 November 2021.

 

On 4 November 2021, the Business Committee agreed (PDF 39.1KB) a new reporting deadline of 16 December 2021.

 

The Legislation, Justice and Constitution Committee was due to take evidence from the Minister for Climate Change at its meeting on 15 November 2021. However, due to unforeseen circumstances, the session was cancelled at short notice. In lieu of the evidence session, the Committee wrote to the Minister on 15 November 2021, and the Minister responded on 16 November 2021.

The Local Government and Housing Committee published its report on the Welsh Government’s Legislative Consent Memorandum on the Memoranda (PDF 598KB) on 15 December 2021.

Legislative Consent Memorandum – July 2021

 

The Welsh Government laid a Legislative Consent Memorandum (LCM) (PDF 220KB) on the Bill before the Senedd on 19 July 2021.

 

The Business Committee agreed (PDF 38.2KB), in accordance with Standing Order 29.4(i), to invite the Local Government and Housing Committee and the Legislation, Justice and Constitution Committee to consider and report on the Legislative Consent Memorandum on the Building Safety Bill, to the Senedd, by 4 November 2021.

 

The Legislation, Justice and Constitution Committee laid its report (PDF 219KB) on the Memoranda on 10 December 2021. The Welsh Government responded (PDF 522KB) on 4 January 2022.
