Proposed Order in Council - The Government of Wales Act 2006 (Amendment) Order 2021

Section 109 of the Government of Wales Act 2006 (the 2006 Act) allows Her Majesty, by Order in Council, to amend Schedule 7 to the 2006 Act, provided that a draft of the Order has first been approved by the Senedd and both Houses of Parliament.

 

Standing Order 25 provides for the procedure to be followed in respect of the consideration of Orders in Council that are to be made under section 109 of the Government of Wales Act 2006.

 

The Government of Wales Act 2006 (Amendment) Order 2021 will correct a number of deficiencies in Schedules 7A and 7B to the 2006 Act arising from the UK’s exit from the European Union and correct drafting errors that were inserted into the 2006 Act by the Wales Act 2017. It will also provide a carve out from the consent requirements in Schedule 7B in respect of concurrent and concurrent plus functions created by EU exit legislation and the Coronavirus Act 2020.

 

The proposed Order was laid before the Senedd on 10 December 2020. 

 

The Business Committee referred the proposed Order to the Legislation, Justice and Constitution Committee for detailed consideration. The Committee published its report on 14 January 2021.

 

Following the Legislation, Justice and Constitution Committee’s scrutiny of the proposed Order, the draft Order and Explanatory Memorandum were laid in the Table Office on 19 January 2021.
