The Committee considered further correspondence and agreed to close the petition in light of the fact that the Minister for Education has previously demonstrated a willingness to intervene in situations where there are concerns that local authorities have not followed the School Organisation Code, and because there appears to be little prospect of the Welsh Government introducing an appeals process against school closures at this time. The Committee wished to thank the petitioners for their engagement and wish them well for the future.

The Committee agreed to write to seek the views of a range of organisations on the case for, and possible implications of, introducing an appeals mechanism in relation to school closure proposals, including:

  • The Welsh Local Government Association and the Association of Directors of Education in Wales;
  • Campaign groups; and 
  • Representatives of the legal sector.

The Committee considered further correspondence on the petition and agreed to request a paper setting out the scrutiny given to the issue of appeals against school closures at the time the School Standards and Organisation (Wales) Act 2013 was passed, together with options for taking forward further consideration of the merits of an appeals mechanism.

The Committee considered further correspondence and agreed to:

·         write to the petitioners and others to advise them that the appropriate course of action is for them to raise their concerns directly with the Minister for Education and request that she considers whether there is justification for her to intervene in this case, as outlined in her letter; and 

·         write to the Minister for Education to ask her for a response to the proposal that there should be a direct route for school governors to appeal decisions reached under the School Organisation Code, and to provide details of any consideration given to an appeals process during the review of the Code.

The Committee considered the petition and agreed to write to the Minister for Education to:

  • ask what the Welsh Government’s intentions are in circumstances where local authorities do not follow the requirements School Organisation Code; and
  • seek clarification about what powers she has to intervene in decisions on school closures including at what point, and under what circumstances, she is able to intervene.
