Purpose:

The Children and Social Work Bill was introduced in the House of Lords on 19 May 2016. It was a UK Government Bill sponsored by the Department for Education. The Bill related to looked-after children, the welfare of children, and the regulation of social workers.

 

The Bill was subject to the legislative consent process under Standing Order 29. This process is followed in cases where the consent of the National Assembly for Wales is sought by the UK Government to legislate on an issue which could normally fall within the competence of the Assembly.

 

The Welsh Government laid a Legislative Consent Memorandum in relation to the Children and Social Work Bill (PDF, 18KB) on 13 October 2016. This Legislative Consent Memorandum was referred by the Business Committee on 18 October 2016 (PDF, 52KB) to the Children, Young People and Education Committee , with a reporting deadline of 24 November 2016. The Children, Young People and Education Committee published its report (PDF, 355KB) on the LCM on 22 November 2016. The Legislative Consent Motion for the Bill was agreed in Plenary on 29 November 2016.

 

The Welsh Government laid a Supplementary Legislative Consent Memorandum in relation to the Children and Social Work Bill (PDF, 20KB) on 10 November 2016. This Supplementary Legislative Consent Memorandum was referred by the Business Committee on 15 November 2016 (PDF, 51KB) to the Health, Social Care and Sport Committee, with a reporting deadline of 8 December 2016.

 

The Health, Social Care and Sport Committee published its report (PDF, 104KB) on the Supplementary LCM on 5 December 2016. The Supplementary Legislative Consent Motion for the Bill was agreed in Plenary on 13 December 2016.

To propose that the National Assembly for Wales, in accordance with Standing Order 29.6 agrees that provisions in the Children and Social Work Bill, relating to the prohibition of a relevant employer from discriminating against a person who applies for a children's social care position because it appears to the employer that the applicant has made a protected disclosure, in so far as they fall within the legislative competence of the National Assembly for Wales, should be considered by the UK Parliament.

The motion was agreed in accordance with Standing Order 12.36.
