Legislative Consent: Border Security, Asylum and Immigration Bill

The Border Security, Asylum and Immigration Bill (the Bill) was introduced in the House of Commons on 30 January 2025.

 

The long title to the Bill notes that it is a Bill “to make provision about border security; to make provision about immigration and asylum; to make provision about sharing customs data and trailer registration data; to make provision about articles for use in serious crime; to make provision about serious crime prevention orders; to make provision about fees paid in connection with the recognition, comparability or assessment of qualifications; and for connected purposes.”

 

The Bill is subject to the legislative consent process under Standing Order 29. This is when the consent of the Welsh Parliament is sought by the UK Government to legislate on an issue which falls within the competence of the Senedd.

 

The Legislative Consent Motion for the Border Security, Asylum and Immigration Bill was agreed in plenary on 21 October 2025.

 

Legislative Consent Memorandum – February 2025

 

The Welsh Government laid a Legislative Consent Memorandum (LCM) (PDF 170KB) on the Bill before the Senedd on 17 February 2025.

 

The Business Committee referred the LCM to the Children, Young People and Education Committee, the Equality and Social Justice Committee, the Local Government and Housing Committee and the Legislation, Justice and Constitution Committee with a reporting deadline of 2 May 2025 (PDF 39KB).

 

The Legislation, Justice and Constitution Committee laid its report (PDF 160KB) on 1 May 2025. The Welsh Government responded (PDF 174KB) to the report on 17 June 2025.

 

The Children, Young People and Education Committee laid its report (PDF 260KB) on 2 May 2025.

 

The Equality and Social Justice Committee laid its report (PDF 182KB) on 2 May 2025.

 

The Children, Young People and Education Committee and the Equality and Social Justice Committee agreed to write jointly to the Welsh Government (PDF 118KB) and to certain stakeholders (PDF 153KB), to seek views about the LCM. Their responses are available below:
